1. Agreement
These Terms of Service govern your access to and use of Nibbli. By creating an account, accepting an invitation, subscribing, or otherwise using Nibbli, you agree to these terms.
If you use Nibbli on behalf of a restaurant, company, or other organization, you confirm that you have authority to accept these terms for that organization.
2. The service
Nibbli provides software for restaurants to create, manage, translate, publish, and measure QR menus. Features may include menu import, menu editing, QR codes, public menu pages, team access, analytics, image uploads, billing, and related tools.
Some features may be offered as preview, beta, or experimental features. Those features may change, break, or be removed as the product evolves.
3. Accounts and team access
You are responsible for keeping your account secure and for all activity that happens through your account. You must provide accurate account information and keep it up to date.
Restaurant owners and authorized team members can invite others into a workspace. The restaurant is responsible for managing who has access, assigning appropriate roles, and removing people who should no longer have access.
4. Restaurant content
Restaurants are responsible for the content they add to Nibbli, including menu names, item descriptions, prices, allergens, dietary labels, images, availability, translations, and QR codes.
You must make sure that public menu information is accurate and lawful. This is especially important for allergens, dietary information, prices, taxes, availability, and any health or safety information. Nibbli can help format, extract, or translate menu content, but the restaurant remains responsible for reviewing and approving what guests see.
You confirm that you have the rights needed to upload and publish any content you add to Nibbli.
5. Public QR menus
Nibbli may generate public menu pages and QR links for restaurants. You are responsible for where and how you display those QR codes, and for keeping printed or shared QR materials up to date.
We may collect basic scan and view analytics to operate the service, show restaurants how menus are used, and improve Nibbli.
6. AI-assisted features
Nibbli may offer AI-assisted features such as menu extraction, menu formatting, or translations. These features are provided to speed up your work, not to replace human review.
AI output can be incomplete or wrong. You are responsible for checking all generated content before publishing it, especially prices, allergens, ingredients, dietary labels, and translations.
7. Subscriptions and billing
Paid plans, trials, prices, billing periods, taxes, and included features are shown at checkout or in the billing area. Unless stated otherwise, prices exclude VAT and other applicable taxes.
Payments are processed by a payment provider. By starting a paid subscription, you authorize the payment provider to charge the selected payment method according to the chosen plan. You are responsible for keeping billing details current.
If payment fails or a subscription is canceled, suspended, or expired, access to paid features may be limited or disabled.
8. Acceptable use
You must not use Nibbli to:
- break the law or infringe someone else’s rights;
- upload malicious code, illegal content, or content you do not have permission to use;
- interfere with the service or attempt to bypass security, billing, rate limits, or access controls;
- scrape, copy, or reverse engineer the service except where law allows it;
- misrepresent menu information in a way that could mislead or harm guests;
- use Nibbli for spam, fraud, harassment, or abusive activity.
We may suspend or remove access if we reasonably believe these rules have been violated.
9. Third-party services
Nibbli relies on third-party providers for infrastructure, authentication, payments, email delivery, analytics, file storage, and other operations. Their services may be subject to their own terms and availability.
Nibbli is not responsible for third-party services outside our control, but we choose providers that support the service we offer.
10. Intellectual property
Nibbli and its software, design, branding, and documentation are owned by Nibbli or its licensors. These terms do not transfer ownership of Nibbli to you.
You keep ownership of the restaurant content you upload. You grant Nibbli the rights needed to host, process, display, translate, analyze, and otherwise use that content to provide and improve the service.
11. Availability and changes
We aim to keep Nibbli reliable, but we do not guarantee that the service will always be available, uninterrupted, or error-free. Maintenance, updates, provider outages, security issues, or operational problems may affect availability.
We may change, add, or remove features as the product develops. If a change materially affects a paid plan, we will take reasonable steps to make that clear.
12. Termination
You may stop using Nibbli at any time. Restaurant owners may request workspace closure by contacting us.
We may suspend or terminate access if you breach these terms, create risk for Nibbli or others, fail to pay, or use the service in a way that is unlawful or harmful.
13. Disclaimers and liability
Nibbli is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim warranties that the service will be uninterrupted, error-free, or fit for every specific purpose.
To the fullest extent allowed by law, Nibbli will not be liable for indirect, incidental, special, consequential, or lost-profit damages. Our total liability for claims relating to the service is limited to the amount you paid to Nibbli for the service in the three months before the event giving rise to the claim.
Nothing in these terms limits liability where the law does not allow it to be limited.
14. Governing law
These terms are governed by the laws of Belgium, unless mandatory consumer or data protection laws provide otherwise.
